Associate Professor of Law Tim McFarlin’s latest article, “Infringing Uses, Not Works,” has been accepted for publication by the South Carolina Law Review. The Review is the flagship scholarly journal of the University of South Carolina Joseph F. Rice School of Law.
“Infringing Uses, Not Works” is expected to be published in Book 1 of the Review’s 76th volume this fall. It explores how the U.S. Supreme Court’s ruling in Andy Warhol Foundation v. Goldsmith may impact the future of copyright law.
“I’m really excited to share my reflections on Warhol,” McFarlin said, “which I hope will help courts and scholars navigate what I think is a core though controversial takeaway: artworks themselves cannot infringe copyright, only how we use them.”
