
Associate Professors Ramona Albin and Matt Woodham have co-authored a new article for the St. John's Law Review titled “Gilded Executive Privilege: The Unstated Evidentiary Rule in Trump v. United States.”
In this timely and thought-provoking piece, they examine an underexplored aspect of the Supreme Court’s recent ruling—its sweeping evidentiary decision limiting the admissibility of official acts evidence in the prosecution of a former president’s private conduct.
They argue that this decision introduces what they call a “gilded executive privilege”— an unstated, absolute and unwaivable evidentiary shield with far-reaching consequences for accountability and the future of presidential immunity.
